ELV-PATENT-001
We propose the Pattern Attribution Treaty (PATENT) — a governance framework for technologies derived from substrate-invariant computation, in which attribution replaces ownership as the primary legal instrument. For technologiesoperating at the AGI capability frontier, openness is not an ethical preference buta structural requirement derivable from first principles. Three interlocking arguments are developed: the Obsolescence Ceiling Theorem, the Closed-System Instability Theorem, and the Open Attribution Architecture. We define PATENT termsand release all referenced substrate-invariant technologies under this framework.

OCPL-1.0 — Open Computational Patent LicenseSPDX-License-Identifier: OCPL-1.0 · ELV-OCPL-001The first license to govern substrate-invariant computational methods across anyphysical medium with an explicit patent grant, open derivative space, and attributionrequirement simultaneously.1 Preamble — The Gap This License FillsThree legal regimes currently exist for open technology:ˆ CC-BY 4.0: covers expression but explicitly excludes patent rights (§2(b)(2)).ˆ GPL / Apache / MIT: cover software copyright with implicit patent grants, butstop at hardware and biological substrates.ˆ CERN-OHL 2.0: covers hardware with an explicit patent grant, but stops atsoftware and substrate-invariant methods. The gap is precise: no existing license covers substrate-invariant computational methodswith an explicit patent grant, an open derivative space, and an attribution requirement simultaneously. OCPL-1.0 fills this gap. CERN-OHL did for hardware what nobodyhad done for computation. OCPL-1.0 does for substrate-invariant computation whatCERN-OHL did for hardware.

PAC/SPDS outputs are deterministic assemblies from a finite, humanauthored, cryptographically signed Library (L). They are NOT generated by a systemthat draws on learned statistical patterns from uncontrolled external corpora. The operative AI labeling trigger — AI generation — does not apply because: the Selection function D emits a signed decision record against a fixed library version; CompositionC assembles pre-authored, immutable blobs; Rendering R serializes deterministically. Atno stage does the system draw on weights, embeddings, or stochastic parameters beyondwhat is specified in the library itself.
